Texas THC laws in 2026
Texas and federal hemp rules have changed several times in the last year. Here's where things stand, in plain English, and what it means for what you'll find on our shelf.
The short version
Updated October 27, 2026. This page is general information, not legal advice. Rules are changing and court cases are pending.
| Rule | Status | What it means for you |
|---|---|---|
| 21+ to buy | In effect | You need a valid photo ID showing you're 21 or older to buy hemp THC products. |
| Vape ban | In effect since Sept 1, 2025 | Texas banned the sale of cannabinoid vapes, including THC and CBD vapes. |
| DSHS "total THC" rules | In effect since March 31, 2026; court challenge pending | THCA now counts toward the THC limit, which makes high-THCA flower, pre-rolls and concentrates noncompliant for retail sale. |
| Federal hemp definition change | Takes effect Dec 11, 2026 | Finished hemp products capped at 0.4 mg total THC per container nationwide. Most THC edibles exceed that. |
What changed in Texas
The vape ban (September 2025)
A Texas law that took effect September 1, 2025 bans selling vape products that contain cannabinoids. That covers THC and CBD vapes, which is why you won't find them on our shelf.
The DSHS total-THC rules (March 2026)
The Texas Department of State Health Services adopted new hemp rules effective March 31, 2026. The big change is how THC is measured: THCA, which turns into delta-9 THC when heated, is now counted toward the legal limit. High-THCA hemp flower, pre-rolls and concentrates can't meet that limit, so they're treated as noncompliant for sale.
Hemp businesses sued. A Travis County court blocked the rules in the spring, but the appeals court lifted that block in June 2026, and the rules are enforceable while the appeal continues. That could change if a court rules otherwise. Texas has also reinstated Schedule I listings that cover hemp THCs other than delta-9, and courts haven't settled exactly how those apply.
What changes federally on December 11, 2026
Congress rewrote the federal definition of hemp in late 2025. After a short delay, most of the change takes effect December 11, 2026. It counts total THC, including THCA, and caps finished products at 0.4 mg of total THC per container. For comparison, a single typical 5 mg gummy is more than ten times that cap. Bills to delay, repeal or replace the change have been introduced but, as of mid-October 2026, none had moved out of committee.
Unless Congress acts, most THC gummies and edibles sold today, here and nationwide, won't qualify as hemp after December 11. CBD products with little or no THC are less affected, though it depends on the product.
